Wirt County Mugshots as Records
A booking photo records a person's appearance during an arrest or corrections intake. The image belongs to that event. It does not prove a conviction, explain the court outcome, or show whether the person is now free, supervised, transferred, or confined elsewhere. For Wirt County matters, the arresting agency and the agency that held the person may have separate records. West Virginia law supports a precise official request. West Virginia Code §29B-1-2 includes photographs within the definition of writings used for public records. The sheriff may instead have an arrest report, warrant-execution record, incident report, commitment paperwork, or transport log. An image held by WVDCR should be requested from WVDCR rather than asking the local office to retrieve another agency's file.
Communications and payment services associated with corrections do not become mugshot sources merely because they offer an app. WVDCR references services for visits, messages, or deposits, but the research found no basis to describe them as Wirt County released-photo tools. The statewide VINE service can carry an agency photo in some records, yet photo availability varies and a VINE entry is not a permanent gallery.
Request a Wirt Booking Photo
The best route for a past North Central image is a specific written records request. West Virginia FOIA requires reasonable specificity. Under §29B-1-3, the public body must act as soon as practicable and within five days excluding Saturdays, Sundays, and legal holidays. The agency may produce the record, arrange inspection, or deny the request in writing. That is an action period, not a guarantee of final delivery within five days.
- Identify the person by full name, aliases, DOB or WVDCR OID, and case number if known.
- Name Wirt as the committing or sentencing county, North Central as the facility, and the approximate booking range.
- Request the specific file photograph and related nonexempt identifiers needed to confirm that it belongs to the correct custody event.
- Ask for electronic delivery. If any part is exempt, request redaction and production of the segregable remainder.
- For a sheriff-created image, send a separate request for the local photograph and arrest record through the official sheriff contact route.
Policy 142.00 contains a request form but does not make a special form mandatory. It lists paper copies at $0.15 per one-sided page up to the stated standard size, plus postage paid in advance. A photo on a current detail can help distinguish two people with similar names, but it does not repair an uncertain status.
VINELink may also carry a photo supplied by the reporting agency. Treat it the same way: use the image as an identity aid and the event label as a prompt for verification. A “released” custody event shows that the person left the reporting agency's custody. It does not exclude parole, another warrant, prison movement, USMS custody, ICE custody, or another jail.
Wirt Mugshot Removal Rules
West Virginia Code §62-1-6a is a narrow social-media rule. It limits a covered law-enforcement agency's social posting of a booking photo for a minor offense unless a listed basis applies, such as conviction, fugitive or threat grounds, or a court order. After specified favorable results, a person may ask the posting agency to remove the photo from its social page, and the statute sets a 14-day removal period.
The rule does not cover every image or every agency. DCR and its subordinate entities are excluded from the statute's agency definition for this provision. Removal from one law-enforcement social page does not automatically remove a WVDCR file photograph, a court record, news coverage, or copies held elsewhere. No enacted statewide law banning “pay to remove” mugshot practices was verified, so a prior proposal must not be described as current law.
Ask the agency that posted the image whether §62-1-6a applies to the actual event and outcome. Supply the disposition or order needed to support the request. Do not send money to an unverified removal service or assume it controls a government source. When the photo came from a corrections file rather than a covered law-enforcement social account, use WVDCR's record and correction channels.
Wirt Expungement and Booking Photos
Release does not erase a case or photo. Under §61-11-25 and §61-11-26, some dismissed or deferred matters and certain convictions may qualify for expungement, subject to exclusions, procedure, and waiting rules. Expungement is a court process that can seal qualifying court and law-enforcement records. It is not shown by a name disappearing from a jail search.
For a Wirt case, a state-conviction petition is filed through the circuit clerk in the county where the case was filed. Eligibility depends on the case.
